PhotoRush Terms of Service

These terms are an agreement between you and Sonset Inc. ("Sonset", "we", "us"), the operator of PhotoRush. By creating an account or booking a session you agree to them. If you do not agree, please do not use PhotoRush.

1. What PhotoRush is

PhotoRush lets you book a professional photographer for a session at the time and place you choose. Sonset runs the app, takes your booking, dispatches an available photographer and handles payment. Photographers are independent professionals who accept jobs through PhotoRush. Sonset checks every photographer before they can take bookings, and they are bound by a separate agreement with Sonset.

2. Your account

You must be 18 or older to book. Keep the email address you sign in with secure; what is done through your account is your responsibility. Give us accurate details, including a phone number your photographer can reach you on. You can delete your account at any time from Account settings.

3. Booking and pricing

The price is shown before you confirm and is in Canadian dollars: a flat rate for a 2 hour session, plus any extras you add. Where sales tax applies, it is included in the price shown. A session is confirmed when a photographer accepts your request. If no photographer is available, your request expires and nothing is charged.

4. Payment

A card is required to book. Your card is held for the booking amount once a photographer accepts, and charged when the session is completed or when one of the fees below applies. Payments are processed by Stripe. Sonset never sees your full card number.

5. Cancellations and no shows

The app shows the exact fee before you confirm a cancellation.

6. The session

You are responsible for having permission to be photographed at the location and for the safety of the location. A session runs for the booked time; more time must be booked as an extra. A photographer may end a session early if they feel unsafe or are asked to do something unlawful, and the session is then charged in full. Treat your photographer with respect; abuse ends your access to PhotoRush.

7. Photos and rights

The photographer and Sonset keep the copyright in the photos. Once the session is paid for, you receive a permanent, worldwide licence to use, copy, print and share the delivered photos for your personal and business purposes, including on social media. You may not resell the photos as stock or present yourself as the photographer. We do not use your photos in our marketing without your consent.

Photos are delivered in the app and stay there for three months after delivery. After that they are deleted, unless you extend their storage in the app before they expire (currently $10 for another 12 months). Download and keep your own copies; PhotoRush is not a backup service. Ask for changes to delivered photos within 7 days of delivery.

8. What we are responsible for

We work hard to send you a reliable professional, but we cannot guarantee availability, a particular photographer or a particular result. To the extent the law allows, Sonset's total liability for anything arising from a booking is limited to the amount you paid for that booking, and Sonset is not liable for indirect losses such as lost profits or a missed event. Nothing in these terms limits the rights consumer protection law gives you that cannot be waived.

9. Problems and disputes

If something goes wrong, contact us first through the details on our website; most issues are resolved with a refund or a new session. These terms are governed by the laws of Ontario and of Canada, and the courts of Ontario have jurisdiction over any dispute.

10. Changes to these terms

We may update these terms. When we do, the date at the top changes and you are asked to accept the new terms before your next booking. Booking again after that is acceptance.
